Museum Online Collection terms and conditions
This web page provides South Lanarkshire Leisure and Culture Museum Collections Navigator User Terms and Conditions.
Copyright of Content
What is copyright?
Copyright exists to give the creators of:
- literary, dramatic, musical, and artistic works
- sound recordings, broadcasts, films and cable programmes
- typographical arrangement of published editions
rights to control the ways in which their material may be used. Copyright usually lasts 70 years from the end of the year in which the creator of the work died, but this can vary in some cases. If you require further information you are advised to refer to the Intellectual Property Office website www.ipo.gov.uk or seek independent legal advice.
Copyright is one of several Intellectual Property Rights (“IPRs”) and is subject to the Copyright, Designs and Patents Act 1988 and various European Union legislation. Other IPRs include patents, trade marks and designs.
The material (referred to as the Content) – photographs, images and illustrations (such as paintings, watercolours, prints), maps and plans (including technical drawings), diagrams, newspaper extracts, manuscripts, 3D objects, sound and video recordings, graphics, artwork, text, animation and research information - contained in this website is protected by copyright laws. Unless otherwise stated all Content shown on this website is the copyright of South Lanarkshire Council (“the Council”).
Anyone republishing Content from this website without permission is liable for any resulting infringement of copyright and the Council reserves the right to enforce its rights in such manner as it decides is appropriate.
We have made every effort to locate copyright holders of materials included on this website in order to obtain their permission to publish it. All known copyright owners for this website are identified.
Moral rights
It is the policy of this website and the moral right of an author to be identified as the author of his or her own work. On this website the author is always identified, if known.
Use of Collections Navigator
General
We want you to enjoy having access to and use of this website and related Council or South Lanarkshire Leisure and Culture Ltd websites.
This access is provided subject to the following terms and conditions. Please read these terms and conditions carefully as your access to and use of Collections Navigator will be deemed as acceptance. Unauthorised attempts to deny service, upload information, change information or attempts to access non public data from this service are strictly prohibited.
Internet websites normally qualify for copyright protection and database right protection. Each individual page is considered as a broadcast. In addition, any attempt to mount this material on another website will be considered an act of communicating the content to the public without consent. This will infringe the Right of Communication to the Public. Database right will also be an issue as the site itself constitutes a database regardless of the status of the individual items included in it.
Copyright in a broadcast web page covers the signal sent, whereas copyright and database right cover the contents, so copyright would be infringed by:
- copying of screen pages onto a computer
- photographing multiple pages from the screen
- showing screen pages in public to a paying audience
- including screen pages on another website
Please note: this list is not exhaustive and you should be aware that there may be other ways of infringing copyright.
